Terms and Conditions of Sale

1. These Terms and Conditions govern the sale of products by PHOTHO Tomasz Sergej, ul. Iłłakowiczówny 4, 70-787 Szczecin, Poland, VAT ID: PL9552220945, e-mail: sklep@sergej.pl, tel.: 575 836 934, via the online store and online marketplace platforms.

2. Information about products, their prices, delivery costs, available payment methods and the expected order processing time is provided in the relevant product offer before the order is placed.

3. By placing an order, the Customer submits an offer to conclude a sales contract. The sales contract is concluded when the Seller accepts the order for processing or in accordance with the rules applicable on the relevant sales platform.

4. In the case of sales through external platforms, the terms of the relevant platform operator may additionally apply to the operation of the user account, the technical order placement process and payment handling.

5. A consumer has the right to withdraw from the contract without giving any reason within 14 days from the day on which the product is delivered to the consumer or to a third party indicated by the consumer, other than the carrier.

6. To exercise the right of withdrawal, the consumer must send the Seller, before the expiry of the above period, an unequivocal statement of withdrawal, in particular by post or e-mail.

7. The returned product must be sent back without undue delay and no later than within 14 days from the date on which the statement of withdrawal was submitted, to the following address: PHOTHO Tomasz Sergej, ul. Iłłakowiczówny 4, 70-787 Szczecin, Poland.

8. The direct cost of returning the product in the event of withdrawal from the contract shall be borne by the buyer, unless applicable law provides otherwise.

9. The Seller shall reimburse all payments received from the buyer, including the cost of the cheapest ordinary delivery method offered at the time of purchase, without undue delay and no later than within 14 days from the date of receipt of the statement of withdrawal. The Seller may withhold reimbursement until the product has been received back or until the buyer has provided proof of having sent it back, whichever occurs first.

10. The right of withdrawal does not apply in cases provided for by applicable law, in particular with regard to products made to the consumer’s specifications or clearly personalised, as well as other goods or services excluded from the right of withdrawal by law.

11. The Seller shall be liable to the consumer for any lack of conformity of the goods with the contract in accordance with applicable law.

12. Complaints regarding goods may be submitted by e-mail to sklep@sergej.pl or in writing to: PHOTHO Tomasz Sergej, ul. Iłłakowiczówny 4, 70-787 Szczecin, Poland. A complaint should preferably include the buyer’s details, order number, description of the lack of conformity and the requested remedy. If delivery of the goods is necessary for handling the complaint, the Seller will inform the Customer about the method of collection or return at the Seller’s expense.

13. The Seller shall respond to a consumer complaint within 14 days from the date of receipt, unless applicable law provides for a different effect or procedure.

14. If a parcel is returned to the Seller for reasons attributable to the Customer, in particular due to an incorrect address, failure to collect the parcel on time or unjustified refusal to accept delivery, the Seller may contact the Customer in order to arrange re-shipment or a refund.

15. In the case of re-shipment referred to in clause 14, the cost of re-delivery shall be borne by the Customer, unless the parties agree otherwise or the reason for the parcel’s return was not attributable to the Customer.

16. If a parcel is returned to the Seller for reasons attributable to the Customer, the Seller may claim reimbursement of the actual costs incurred in connection with the uncollected parcel, to the extent permitted by applicable law.

17. In the event of a justified complaint concerning goods not in conformity with the contract, the consumer shall not bear any complaint-related costs. If returning the goods is necessary for processing the complaint, the Seller shall collect the goods at its own expense or reimburse the Customer for the reasonable cost of returning them.

18. Product photos are for illustrative purposes and are prepared with due care in order to present the appearance, colour and features of the products as accurately as possible. Due to individual settings of end devices, in particular monitors, phone or tablet displays, as well as lighting conditions, the Customer’s perception of the product colour may slightly differ from the actual colour. The above does not exclude or limit the Seller’s liability for any lack of conformity of the goods with the contract.

19. Customers’ personal data is processed by the Seller in accordance with applicable law and the principles set out in the privacy policy available in the online store.

20. In matters not regulated by these Terms and Conditions, the relevant provisions of law shall apply. In the case of consumers from European Union member states, these Terms and Conditions do not exclude the protection granted to them by the mandatory provisions of the law of the country of their habitual residence.
